Case No. 2003-001523
The Board rejected a proposed counter settlement stipulation between the parties. The counter stipulation provides for a reprimand, a fine of $5,000.00, plus costs. The complaint involved architectural services provided by the Respondent for a Publix shopping center in Miami, Florida.
Janet Bakel
Case No. 2003-001287
The Florida Board of Architecture and Interior Design entered a final order approving a settlement stipulation that included a reprimand, $1,000.00 fine, and costs of $150.00. The complaint alleged that Mrs. Bakel practiced interior design through a business entity that did not have a certificate of authorization.
Victor E. Dekonschin
Case No. 2003-002792
The Florida Board of Architecture and Interior Design announces that on July 31, 2003, a final order was entered suspending Victor E. Dekonschin, Naples, Florida, for misconduct in the practice of architecture and aiding unlicensed activity.
Mr. Dekonschin's unlicensed partner used his seal on a set of plans that were submitted to the building department.
After reviewing the evidence the Board suspended Mr. Dekonschin for one year, imposed a fine of $1,000.00, and placed Mr. Dekonschin's license on probation for two years.
Carl Gaiser
Case No. 2002-010810
The Florida Board of Architecture and Interior Design entered a final order approving a settlement stipulation that included a $3,500.00 fine and costs. The complaint alleged that Mr. Gaiser practiced architecture within this state without a license. Mr. Gaiser is a licensed architect in the State of Michigan.
John W. Kemper
Case No. 1999-08900
The Florida Board of Architecture and Interior Design announces that on July 31, 2003, a final order was entered approving a settlement stipulation with John W. Kemper, Naples, Florida, regarding a complaint involving allegations of plan stamping
Mr. Kemper, a licensed architect, signed and sealed numerous plans for commercial projects prepared in his Naples office by unlicensed draftsman while working full time in his other office located in Connecticut.
After reviewing the settlement stipulation, the Board suspended Mr. Kemper for two years, imposed a fine of $3,000.00, and placed Mr. Kemper's license on probation for two years.
William J. Lindh
Case No. 2001-07806
The Florida Board of Architecture and Interior Design entered a final order approving a settlement stipulation that allowed Mr. Lindh to place his license in an inactive status and prohibited Mr. Lindh from ever practicing architecture in the State of Florida. The complaint alleged that Mr. Lindh committed negligence and failed to exercise proper responsible supervisory control for a project in Sarasota, Florida.
Leonard Nobrega
Case No. 2002-01990
The Florida Board of Architecture and Interior Design announces that on July 31, 2003, a final order was entered imposing a fine of $5,000.00 against Leonard Nobrega, Cape Canaveral, Florida, for the unlicensed practice of architecture.
Mr. Nobrega altered plans that were previously signed and sealed by a licensed architect. The plans were then submitted to the building department without the knowledge of the licensed architect.
After reviewing the evidence that showed Mr. Nobrega was offering and providing architectural services without a license, the Board imposed a fine of $5,000.00.
Phillip B. Pavon
Case No. 2002-005424
The Florida Board of Architecture and Interior Design announces that on July 31, 2003, a final order was entered imposing a fine of $10,000.00 against Phillip B. Pavon, Coral Springs, Florida for the unlicensed practice of architecture and interior design.
Mr. Pavon entered into a contract with Andre Posse to perform architectural and interior design services for property located at 2541 Golfview Drive, Weston, Florida. Mr. Pavon is not licensed to perform either architectural or interior design services.
After reviewing the evidence that showed Mr. Pavon was offering and providing architectural and interior design services, the Board entered a final order imposing a fine of $10,000.00.
Erhard J. Stritzel
Case No. 2003-002794
The Florida Board of Architecture and Interior Design announces that on July 31, 2003, a final order was entered imposing a fine of $5,000.00 against Erhard J. Stritzel, Naples, Florida, for the unlicensed practice of architecture.
Mr. Stritzel, who is not a licensed architect, used his partner's seal and forged his initials to seal a set of plans that were than submitted to the building department.
After reviewing the evidence that showed Mr. Stritzel was providing architectural services without a license, the Board imposed a fine of $5,000.00.
Tim K. Tripp
Case No. 2003-044259
The Florida Board of Architecture and Interior Design announces that on July 31, 2003, a final order was entered imposing a fine of $5,000.00 against Tim K. Tripp, Leigh Acres, Florida, for the unlicensed practice of architecture.
Mr. Tripp offered and contracted to provide architectural services without being properly licensed. Mr. Tripp was previously licensed; however, his licensed went into a null and void status for failing to renew.
After reviewing the evidence that showed Mr. Tripp was offering and providing architectural services without a license, the Board imposed a fine of $5,000.00.
Oscar Woody, Jr
Case No. 2002-01022
The Florida Board of Architecture and Interior Design announces that on July 31, 2003, a final order was entered approving a settlement stipulation with Oscar Woody, Jr., Pensacola, Florida, regarding a complaint involving allegations of plan stamping, practicing beyond the scope of his architectural license, and negligence.
Mr. Woody, a licensed architect, signed and sealed plans prepared by an unlicensed draftsman, Lee Mabire. Mr. Mabire had entered into a contract to provide architectural services to remodel a commercial building located in Pensacola, Florida.
After reviewing the settlement stipulation, the Board suspended Mr. Woody for one year, imposed a fine of $3,500.00, and placed Mr. Woody's license on probation for three years.
