I. Unlicensed Cases

ARES Architectural Daum Caccese Kolany
Jerry Daum
Case Nos. 2004-049481 & 2004-049487

Probable Cause was found that ARES Architectural Daum Caccese and Jerry Daum of Hobe Sound, Florida were offering architectural services without a certificate of authorization in a yellow page advertisement. A Notice and Order to Cease and Desist was issued along with the requirement that Jerry Daum sign an affidavit stating he will refrain from offering architectural services through the firm unless it becomes properly licensed. If Mr. Daum fails to return the affidavit, an Administrative Complaint seeking fines will be filed.

Christina Auer
Auer-Smith Interiors
Case No. 2004-046637

Probable Cause was found that Christina Auer of Jupiter, Florida is not licensed and is offering interior design services in an advertisement contained in the Florida Design magazine. A Notice and Order to Cease and Desist was issued along with the requirement that Ms. Auer sign an affidavit stating she has changed her advertisement to delete all references to interior design. If Ms. Auer fails to return the affidavit, an Administrative Complaint seeking fines will be filed.

Auer-Smith Interiors
Case No. 2004-046632</p>

Probable Cause was found that Lori Auer-Smith of Jupiter, Florida is not licensed and is offering interior design services in an advertisement contained in the Florida Design Magazine. A Notice and Order to Cease and Desist was issued along with the requirement that Ms. Auer-Smith sign an affidavit stating she changed her advertisement to delete all references to interior design. If Ms. Auer-Smith fails to return the affidavit, an Administrative Complaint seeking fines will be filed.

B&D Interiors, Inc.
Aviva Davis
Case Nos. 2004-044526 & 2004-044516

Probable Cause was found that B&D Interiors, Inc. of Boca Raton, Florida is not licensed and is offering interior design services in an advertisement in the Design Magazine without a certificate of authorization. The firm does employ a licensed interior designer, Aviva Davis. A Notice and Order to Cease & Desist was issued along with the requirement that Lianne Berger sign an affidavit that she will not offer such services in the future through a business entity, until she obtains a Certificate of Authorization. If Ms. Berger fails to return the affidavit, an Administrative Complaint seeking fines will be filed.

W.R. “Buddy” Braren, III
Case No. 2004-043609

Probable Cause was found that W.R. “Buddy” Braren, III of Monticello, Florida is not licensed and prepared drawings for an addition to the Mount Pleasant Missionary Baptist Church for permitting purposes. The Building Department issued a building permit without the plans being signed and sealed by an architect or engineer. An Administrative Complaint seeking fines was filed and a Notice and Order to Cease and Desist was issued.

Rick Campbell
Campbell Design Consultants
Case No. 2004-002071

Probable Cause was found that Rick Campbell of Odessa, Florida is not licensed and provided interior design services on commercial projects which included a beauty salon and a restaurant. An Administrative Complaint seeking fines was filed and a Notice and Order to Cease and Desist was issued.

Nadya Troche Chapra
Case No. 2004-007571

Probable Cause was found that Nadya Troche Chapra of Miami Beach, Florida is not licensed and is offering residential and commercial interior design services in an advertisement published in the Boca Design Magazine. Ms. Chapra was served with a Notice and Order to Cease and Desist Order but failed to return the affidavit. The case was resubmitted to the Probable Cause Panel and an Administrative Complaint seeking fines was filed.

Curl Interiors & Witness Designs
Jane M. Curl
Case No. 2003-092720

Probable Cause was found that Curl Interiors & Witness Designs of Jacksonville, Florida is not licensed and the firm is offering interior design services in a paid yellow page advertisement. Jane Curl was served with a Notice and Order to Cease and Desist order but failed to return the affidavit. The case was resubmitted to the Probable Cause Panel and an Administrative Complaint seeking fines was filed.

Pascale Duwat
Case No. 2003-094635

Probable Cause was found that Pascale Duwat of Palm Beach, Florida held himself out as an interior designer in an advertisement found in the Palm Beach Daily News dated November 30, 2003. Mr. Duwat was served with a Notice and Order to Cease and Desist order but failed to return the affidavit. The case was resubmitted to the Probable Cause Panel and an Administrative Complaint seeking fines was filed.

Enviroscapes, Inc.

Case No. 2004-038848

Probable Cause was found that Enviroscapes, Inc. of Miami, Florida is not licensed and is offering interior design services on his website. A Notice and Order to Cease and Desist was issued and an Administrative Complaint seeking fines was filed.

Fabric Zoo
Case No. 2003-084820

Probable Cause was found that Fabric Zoo of Pensacola, Florida is offering interior design services in an advertising flyer. Jeana Pitts was served with a Notice and Order to Cease and Desist Order but failed to return the affidavit. The case was resubmitted to the Probable Cause Panel and an Administrative Complaint seeking fines was filed.

Myler Church Building Systems
Case No. 2004-029718

Probable Cause was found that Myler Church Building Systems of St. Petersburg, Florida is not licensed and the firm’s website offers architectural services and claims to have provided architectural services for numerous churches in Florida. The firm does not have a Florida licensed architect in their Florida office. The firm does have an employee that is licensed in Florida; however, he works full time in Indiana. The firm claims to be a design build firm and therefore is exempt from licensure. An Administrative Complaint seeking fines was filed and a Notice and Order to Cease and Desist was issued.

Probable Cause was found that Christine Desiree Snyder of Sarasota, Florida is not licensed and the Subject is offering interior design and architectural services without a certificate of authorization in an advertisement in the SRQ magazine and on the website. An Administrative Complaint seeking fines was filed and a Notice and Order to Cease and Desist was issued.

Tretheway Associates/Architects, P.A.

Probable Cause was found that Tretheway Associates/Architects, P.A. of Naples, Florida is offering architectural services without a certificate of authorization. A Notice and Order to Cease and Desist was issued, along with the request that Barry Tretheway sign an affidavit stating he will refrain from offering architectural services through the firm, unless it becomes properly licensed. If Mr. Tretheway fails to return the affidavit, an Administrative Complaint seeking fines will be filed.

Kolany of Hobe Sound, Florida is a licensed architect and is offering architectural services without a certificate of authorization in a yellow page advertisement. A Notice and Order to Cease and Desist was issued along with the requirement that Robert Kolany sign an affidavit stating he will refrain from offering architectural services through the firm unless it becomes properly licensed. If Mr. Kolany fails to return the affidavit, an Administrative Complaint seeking fines will be filed.

Probable Cause was found that Rafael A. Rodriguez of West Palm Beach, Florida, a licensed architect is offering architectural services without a certificate of authorization in an advertisement in the phone book. A Notice and Order to Cease and Desist was issued along with the requirement that Rafael Rodriguez sign an affidavit stating he will refrain from offering architectural services through RAR Architect, Inc. unless it becomes properly licensed and will change his advertisement deleting any reference to architecture or words to that effect. If Mr. Rodriguez fails to return the affidavit, an Administrative Complaint seeking fines will be filed.
