I. Unlicensed Cases
Architectural Projects and Design, Inc.
Federico Pena
Case No. 2004-044120
Probable Case was found that Architectural Projects and Design, Inc. of
Miami, Florida is not licensed to practice architecture in the State of Florida
and Federico Pena is doing business as Architectural Projects and Design, Inc. A
Notice and Order to Cease and Desist was issued along with the request that Mr.
Pena sign an affidavit stating he will refrain from offering architectural
services through Architectural Projects and Design, Inc. unless it becomes
properly licensed. Further, Mr. Pena will change his business name deleting any
references to architecture or words to that effect. If Mr. Pena fails to return
the affidavit, an Administrative Complaint seeking fines will be filed.
John W. Burt
Case No. 2005-011590
Probable Cause was found that John W. Burt of Clermont, Florida is licensed
in Indiana but not licensed to practice architecture in the State of Florida and
is offering architectural services on a business card. An Administrative
Complaint seeking fines was filed.
Robert Coba
Case No. 2005-028649
Probable Cause was found that Robert Coba of Homestead, Florida is a licensed
engineer but not licensed to practice architecture in the State of Florida and
contracted to provide architectural services. A Notice and Order to Cease and
Desist was issued and an Administrative Complaint seeking fines was filed.
Kerby Glenn
Case No. 2005-027073
Probable Cause was found that Kerby Glenn of Lake Worth, Florida is not
licensed to practice architecture in the State of Florida and his title block
for a residential project offers "Architectural/Interior Design & Drafting". A
Notice and Order to Cease and Desist was issued along with the request that Mr.
Kerby sign an affidavit stating he will refrain from offering architectural,
interior design services or words to that effect. If Mr. Kerby fails to return
the affidavit, an Administrative Complaint seeking fines will be filed.
Judy Graham
Graham Interiors
Case No. 2005-021645
Probable Cause was found that Judy Graham of Sarasota, Florida is not
licensed to practice interior design in the State of Florida and is offering
commercial design services. Ms. Graham's license has been null and void since
February 28, 2003. A Notice and Order to Cease and Desist was issued and an
Administrative Complaint was filed seeking fines.
Brittany L. Guiterrez
Architectural Exteriors & Design
Case No. 2005-002119
Probable Cause was found that Brittany L. Guiterrez of Melbourne, Florida is
not licensed to practice architecture in the State of Florida and is doing
business as Architectural Exteriors & Design. A Notice and Order to Cease and
Desist was issued along with the request that Ms. Guiterrez sign an affidavit
stating she will refrain from offering architectural or interior design services
or words to that effect individually or though Architectural Exteriors & Design
and will change her business name deleting any references to architecture,
interior design or words to that effect. If Ms. Guiterrez fails to return the
affidavit, an Administrative Complaint seeking fines will be filed.
Home of Fine Decorators, LLC
Ted Fine
Case Nos. 2005-046714, 2005-046725 & 2005-046738
Probable Cause was found that Ted Fine of Hallandale, Florida is not licensed
after recently voluntarily relinquishing his license in lieu of disciplinary
proceedings. Until September 16, 2005, Mr. Fine was the President of Home of
Fine Decorators, LLC, which was offering architectural and interior design
services without a certificate of authorization on its website and in an
advertisement dated June 6, 2005. The firm employs licensed interior designers
but not licensed architects. A Notice and Order to Cease and Desist was issued
and an Administrative Complaint seeking fines was filed.
Eric Latine
Gulf Coast Design Group
Case No. 2005-027478
Probable Cause was found that Eric Latine of Bradenton, Florida is not
licensed to practice architecture in the State of Florida and contracted to
provide architectural services for a condominium project. Mr. Latine's invoices
specifically state that architectural services were provided. A Notice and Order
to Cease and Desist was issued and an Administrative Complaint seeking fines was
filed.
Jeff A. Lewis
Architectural Drafting & Design
Case No. 2005-002144
Probable Cause was found that Jeff A. Lewis of Sunrise, Florida is not
licensed to practice architecture in the State of Florida and his title block
for a residential project offers "architectural drafting and design". Further,
Mr. Lewis held himself out as an architect to the client. A Notice and Order to
Cease and Desist was issued and an Administrative Complaint seeking fines was
filed.
Roland Patterson
George E. Patterson & Associates
Case No. 2005-046468
Probable Cause was found that Roland Patterson of Jacksonville, Florida is
not licensed to practice architecture in the State of Florida. Mr. Patterson's
father is a former licensed general contractor. Mr. Patterson took his father's
former general contractor license number and obtained an architectural seal. Mr.
Patterson signed and sealed residential plans using the fraudulent license
number. The licensed architect that actually has the license number did not have
any knowledge of the project. Further, Mr. Patterson is offering architectural
services through a business entity without a certificate of authorization. A
Notice and Order to Cease and Desist was issued and an Administrative Complaint
seeking fines was filed.
Jorge Salazar
Case No. 2005-028631
Probable Cause was found that Jorge Salazar of Miami, Florida is not licensed
to practice architecture in the State of Florida. Mr. Salazar was previously
served with a Notice and Order to Cease and Desist and he signed an affidavit
agreeing to refrain from offering architectural services. After the case was
closed, Mr. Salazar entered into a contract to provide architectural services
and provide architectural construction documents for a residential project. An
Administrative Complaint seeking fines was filed.
Reiner Sanchez
RAS Construction Corp.
Case No. 2004-027260
Probable Cause was found that Reiner Sanchez of Orlando, Florida is not
licensed to practice architecture in the State of Florida and contracted and
provided architectural services for a dental office. Mr. Sanchez also held
himself out as an architect. A Notice and Order to Cease and Desist was issued
and an Administrative Complaint seeking fines was filed.
Emily Anne Smith
O'Brien & Smith Architecture, LLC
Case No. 2005-006804
Probable Cause was found that Emily Anne Smith of Bradenton Beach, Florida is
not licensed to practice architecture in the State of Florida. This is the
second case against Ms. Smith. The first case was initially closed because the
developer of a project held her out as the architect and Ms. Smith had no
knowledge of the advertisement. In this case, Ms. Smith is once again listed as
he individual who provided the architectural design for the project. Further,
Ms. Smith works in a licensed architectural firm and the qualifier responded to
the complaint holding her out as an "architectural designer". A Notice and Order
to Cease and Desist was issued along with the request that Ms. Smith sign an
affidavit stating she will refrain from offering architectural services and she
will refrain from holding herself out as an architectural designer or words to
that effect.
Kerry Turner
Case No. 2005-027488
Probable Cause was found that Kerry Turner of Miramar, Florida is not
licensed to practice architecture in the State of Florida and contracted to
provide architectural drafting services for a residence. The contract provides
that Mr. Turner will produce complete architectural drawings. A Notice and Order
to Cease and Desist was issued along with the request that Mr. Turner sign an
affidavit stating he will refrain from offering architectural services and will
change his contract deleting any references to architecture or words to that
effect. If Mr. Turner fails to return t he affidavit, an Administrative
Complaint seeking fines will be filed.
Vernon J. Thompson
Paradise Design & Construction
Case No. 2004-059549
Probable Cause was found that Vernon J. Thompson of Orlando, Florida is not
licensed to practice architecture in the State of Florida and held himself out
as an architect and contracted to provide architectural services for a church. A
Notice and Order to Cease and Desist was issued and an Administrative Complaint
seeking fines was filed.
II. Licensed Cases
James Barretta
Case No. 2005-051676
Probable Cause was found that James Barretta of Boynton Beach, Florida is a
licensed architect in the State of Florida and based on an audit of the
continuing education credits was deficient. An Administrative Complaint seeking
discipline was filed.
Beasley & Henley Interior Design
Case No. 2004-057750
Probable Cause was found that Beasley & Henley Interior Design of Winter
Park, Florida is a licensed interior design in the State of Florida but failed
to include a license number in an advertisement contained within the Florida
International Magazine. An Administrative Complaint seeking discipline was
filed.
Coastal Design of Citrus County
and Tony Ardolino
Case No. 2005-005846
Probable Cause was found that Coastal Design of Crystal River, Florida is a
licensed architectural firm whose certificate of authorization has been in a
delinquent status. The firm no longer employs a licensed architect even though
it is offering architectural services on the internet. An Administrative
Complaint seeking discipline was filed.
Kimberly A. Marks
Case No. 2005-018687
Probable Cause was found that Kimberly Marks of San Antonio, Texas is
licensed to practice interior design in Florida. Ms. Marks was issued a citation
on April 25, 2005 for failing to take the core curriculum course. Ms. Marks
provided proof of taking the required course but has failed to pay the fine
associated with the citation. An Administrative Complaint seeking discipline was
filed.
Karen Palmer & Kalvin Design Studios, Inc.
Case Nos. 2004-022813 & 2004-022805
Probable Cause was found that Karen Palmer of Naples, Florida and Kalvin
Design Studios, Inc. are licensed to practice interior design in Florida and
entered into a contract to provide design services for a commercial structure.
The contract provides that Ms. Palmer and the firm will provide drawings which
will include structural, electrical, HVAC, and plumbing drawings. The file was
reviewed by the board's expert, who determined that although Ms. Palmer was
attempting to act as an agent for the owner, the language that was used in the
contract specifically offers services that Ms. Palmer is not licensed to
perform. An Administrative Complaint seeking discipline was filed.
Robert Steuber
Architectur, Inc.
Case No. 2004-061288
Probable Cause was found that Robert Steuber of Sarasota, Florida is a
licensed architect who failed to satisfy the terms of a final order that was
entered on October 22, 2004. The final order imposed a $5,000.00 fine and costs
of $213.00 be paid within thirty days of the imposition of the final order. Mr.
Steuber has only paid $1,000.00 since the amounts came due. An Administrative
Complaint seeking discipline was filed.
