I.                   Unlicensed Cases

Edgar Aldana

Case No. 2009-034956

Probable cause was found that Edgar Aldana of Debary, FL, is not licensed to practice architecture in Florida and is using title architect and is offering architectural or commercial design services on a post card advertisement. An Administrative Complaint seeking fines will be filed and a Notice and Order to Cease and Desist will be issued. 

Amazing Plans Solutions Corp.

Magda De La Incera

Case No. 2009-038732

Probable cause was found that Amazing Plans Solutions Corp. and Magda De La Incera of Hialeah, Florida, are not licensed to practice architecture in Florida and are offering architectural services on a post card.  A Notice and Order to Cease and Desist from offering architectural services was issued along with the requirement that Ms. De La Incera sign an affidavit stating she has changed her advertisements and will not offer such services in the future.  If Ms. De La Incera fails to return the affidavit, an Administrative Complaint seeking fines will be filed.

Angel’s Architectural Builders, Inc.

Angel Pintado

Case No. 2008-032937

Probable cause was found that Angel’s Architectural Builders, Inc. and Angel Pintado of Dunedin, FL, are not licensed to practice architecture in Florida and are doing business as Angel’s Architectural Builders, Inc.  A Notice and Order to Cease and Desist from offering architectural services was issued along with the requirement that Mr. Pintado sign an affidavit stating he will not offer architectural  services until properly licensed.  If Mr. Pintado fails to return the affidavit, an Administrative Complaint seeking fines will be filed. 

Architectural Animation & Design, Inc.

Adelson Ramos

Case No. 2009-034715

Probable cause was found that Architectural Animation & Design, Inc. and Adelson Ramos of Holly Hill, Florida, are not licensed to practice architecture in Florida and are offering architectural services. A Notice and Order to Cease and Desist from offering architectural services was issued along with the requirement that Mr. Ramos sign an affidavit stating he will not offer architectural  services until properly licensed.  If Mr. Ramos fails to return the affidavit, an Administrative Complaint seeking fines will be filed.

Gregorio Batista

G. Batista & Associates

Case No. 2009-033209

Probable cause was found that Gregorio Batista and G. Batista & Associates of Cooper City, FL, are not licensed to practice architecture in Florida and is an engineering firm that is offering architectural services without a licensed architect or a certificate of authorization.  An

Administrative Complaint seeking fines will be filed and a Notice and Order to Cease and Desist will be issued. 

Steven D. Bayer

Case No. 2009-030897

Probable cause was found that Steven D. Bayer of Newberry, FL, are not licensed to practice architecture in Florida and are offering architectural services in an advertisement. A Notice and Order to Cease and Desist from offering architectural services was issued along with the requirement that Mr. Bayer sign an affidavit stating he has changed his advertisement and will not offer such services in the future.  If Mr. Bayer fails to return the affidavit, an Administrative Complaint seeking fines will be filed.

David Lee Cogswell

David Lee Cogswell House & Garden Décor

Case No. 2009-018931

Probable cause was found that Dale Caswell of Ft. Lauderdale, FL, is not licensed to practice architecture in Florida and contracted to provide design services for the common area of a condominium. An Administrative Complaint seeking fines will be filed and a Notice and Order to Cease and Desist will be issued. 

Design 7, Inc.

Angel De La Rosa

Case No. 2009-044184

Probable cause was found that Design 7, Inc. and Angel De La Rosa of Naples, FL, are not licensed to practice architecture in Florida and is using the title “Architecture Residential Design” on a business card.  A Notice and Order to Cease and Desist from offering architectural services was issued along with the requirement that Mr. De La Rosa sign an affidavit stating he has changed his business card and will not offer such services in the future.  If Mr. De La Rosa fails to return the affidavit, an Administrative Complaint seeking fines will be filed.

Design Solutions by Atlantic Breeze

Margaret Martin

Case No. 2009-038315

Probable cause was found that Design Solutions by Atlantic Breeze and Margaret Martin of Vero Beach, FL, are not licensed to practice architecture in Florida and are offering commercial design services on a business card. Further, Ms. Martin is offering these services through a corporation without a certificate of authorization.  An Administrative Complaint seeking fines will be filed and a Notice and Order to Cease and Desist will be issued. 

Designs & Permit Drawings LTD, Co.

David Randall Young

Case No. 2009-042904

Probable cause was found that Designs & Permit Drawings LTD, Co. and David Randall Young  of Clearwater, FL, are not licensed to practice architecture in Florida and are offering commercial design services. Further, Mr. Young is offering these services through a corporation without a certificate of authorization.  An Administrative Complaint seeking fines will be filed and a Notice and Order to Cease and Desist will be issued. 

Florida Highland Design

William C. Darby

Case No. 2009-034453

Probable cause was found that Florida Highland Design and William C. Darby of Bartow, FL, are not licensed to practice architecture in Florida and are offering commercial design services and is listed under architects in the yellow pages. A Notice and Order to Cease and Desist from offering architectural or commercial design services was issued along with the requirement that Mr. Darby sign an affidavit stating he has changed his advertisement and will not offer such services in the future.  If Mr. Darby fails to return the affidavit, an Administrative Complaint seeking fines will be filed.

Gamble & Associates Construction, Inc.

Fred J. Hatfield

Case No. 2009-038831

Probable cause was found that Gamble & Associates Construction, Inc. and Fred J. Hatfield of Live Oak, FL, are not licensed to practice architecture in Florida and contracted to provide architectural services for a church project. Further, Mr. Hatfield is offering these services through a corporation without a certificate of authorization. An Administrative Complaint seeking fines will be filed and a Notice and Order to Cease and Desist will be issued. 

Kerby Glenn

Case No. 2009-004683

Probable cause was found that Kerby Glenn of Riviera Beach, FL, is not licensed to practice architecture in Florida and is using the title “Master of Architecture” in his letterhead. An Administrative Complaint seeking fines will be filed and a Notice and Order to Cease and Desist will be issued. 

JAG Services & Design, Inc.

Jerome A. Grant

Case No. 2009-042288

Probable cause was found that JAG Services & Design, Inc. and Jerome A. Grant of Pembroke Pines, FL, are not licensed to practice architecture in Florida and uses the title “architectural consultant”. A Notice and Order to Cease and Desist from offering architectural services was issued along with the requirement that Mr. Grant sign an affidavit stating he has changed his title and will not offer such services in the future.  If Mr. Grant fails to return the affidavit, an Administrative Complaint seeking fines will be filed.

Miami Architect Designs

Angel D. Gamboa

Case No. 2008-036428

Probable cause was found that Miami Architect Designs and Angel D. Gamboa of Miami, FL, are not licensed to practice architecture in Florida and are offering architectural services on its web site.  Further, Mr. Gamboa is offering these services through a corporation without a certificate of authorization. An Administrative Complaint seeking fines will be filed and a Notice and Order to Cease and Desist will be issued. 

Cristina S. Pellizzetti

Case No. 2009-041795

Probable cause was found that Cristina S. Pellizzetti of Boca Raton, FL, is not licensed to practice architecture in Florida and is using the title architect on the web. A Notice and Order to Cease and Desist was issued along with the requirement that Ms. Pellizzetti sign an affidavit stating she has changed her web page to remove the title architect.  If Ms. Pellizzetti fails to return the affidavit, an Administrative Complaint seeking fines will be filed.

Rafael Portuondo

Case No. 2009-025546

Probable cause was found that Rafael Portuondo of Miami, FL, is not licensed to practice architecture in Florida and is referred to as an architect in a magazine article. A Notice and Order to Cease and Desist from using the title architect was issued along with the requirement that Mr. Portuondo sign an affidavit stating he will longer use the title architect. If Mr. Portoundo fails to return the affidavit, an Administrative Complaint seeking fines will be filed.

R & W Architectural Design, LLC

Daryl W. Hosey

Case No. 2009-003212

Probable cause was found that R & W Architectural Design, LLC and Daryl W. Hosey of Port St. Lucie, FL, are not licensed to practice architecture in Florida and is doing business as R&W Architectural Design. Further, Mr. Hosey is offering these services through a corporation without a certificate of authorization. An Administrative Complaint seeking fines will be filed and a Notice and Order to Cease and Desist will be issued. 

II.        Licensed Cases

David E.  Beatty

Case No. 2009-019508

Probable cause was found that David E. Beatty of Rock Hill, SC, is a Florida licensed architect, signed and sealed plans for a residential project without ever meeting with the client. Further, Mr. Beatty signed and sealed the plans while his license was in a suspended status.  An Administrative Complaint seeking discipline will be filed.

Raymond L. Enfield

Case No. 2008-037812

Probable cause was found that Raymond L. Enfield of Elkhart, IN, is a Florida licensed architect, affirmed at renewal that he had completed the required hours. Mr. Enfield was chosen for the audit and has provided only 11 hours of continuing education during the audit period.

An Administrative Complaint seeking discipline will be filed.

LA Design, Inc.

Linda Allard

Case No. 2009-032767

Probable cause was found that LA Design, Inc. and Linda Allard of Boca Raton, FL, is a Florida licensed interior designer, and prepared a proposal to provide architectural, mechanical, electrical, plumbing, and engineering documents. An Administrative Complaint seeking discipline will be filed.

Michael L. Schenck  

Case No. 2008-067349

Probable cause was found that Michael L. Schenck of Lexington, KY is a Florida licensed architect, and was practicing on a suspended license for his failure to take the building code course. Mr. Schenck was notified of the requirements of the original citation and has failed to comply. An Administrative Complaint seeking discipline will be filed.
