Case No. 2005-024611
Probable cause was found that ADG Alpha Design Group of Bayonet Point,
Florida is not licensed to practice architecture in Florida and prepared
drawings to remodel a restaurant and submitted the drawings to the Pinellas
County Building Department for permitting. Further, the firm’s title block
offers architectural design services. A Notice and Order to Cease and Desist was
issued and an Administrative Complaint seeking fines was filed.
Thomas E. Audit
Case No. 2006-038321
Probable cause was found that Thomas Audit of Alachua, Florida is a licensed
professional engineer but not licensed to practice architecture in Florida and
signed and sealed plans for a church without the involvement of an architect.
The architectural drawings were prepared by an unlicensed draftsman that entered
into a contract with the client and held himself out as an architect. The plans
which were signed and sealed by Mr. Audit represent the unlicensed draftsman as
an architect. An Administrative Complaint seeking fines was filed.
Kimberly Nicole Bewley
Kimberly Nicole Bewley + Company
Case No. 2006-044410
Probable cause was found that Kimberly Nicole Bewley of Orlando, Florida is
not licensed to practice interior design or architecture in Florida and is
offering interior design services on her web site. The web site also lists
commercial projects that were designed by them. Ms. Bewley holds herself out as
an interior designer and is offering such services through a business entity
without a certificate of authorization. A Notice and Order to Cease and Desist
was issued and an Administrative Complaint seeking fines was filed.
Johnnie R. Cartwright
Cartwright's Drafting and Design Services, Inc.
Case No. 2006-002464
Probable Cause was found that Johnnie Cartwright of Cape Coral, Florida is
not licensed to practice architecture in the State of Florida and offers
architectural and commercial design services in a yellow page advertisement. At
the May 1, 2006 Probable Cause Panel meeting, probable cause was found and a
Notice and Order to Cease and Desist was issued. Mr. Cartwright was hand served
on July 11, 2006 at his last known address and as of today’s date he failed to
return the affidavit. The case was presented back to the Probable Cause Panel
and an Administrative Complaint seeking fines was filed.

Case No. 2006-041343
Probable cause was found that Concept Uno of Miami, Inc. of Miami Beach,
Florida is not licensed to practice interior design in Florida and contracted to
provide interior design services on a hair salon project. Further, Mr. Bernal
holds himself out as an interior designer throughout the contract and is
offering such services through a business entity without a certificate of
authorization. A Notice and Order to Cease and Desist was issued and an
Administrative Complaint seeking fines was filed.

Case No. 2006-025244
Probable Cause was found that Custom Workroom of Cape Coral, Florida is not
licensed to practice interior design in Florida and is offering interior design
services in a newspaper advertisement. A Notice and Order to Cease and Desist
was issued and an Administrative Complaint seeking fines was filed.
Kimberly A. Diamant

Case No. 2006-028714
Probable cause was found that Kimberly Diamant of Miami, Florida is not
licensed to practice architecture in Florida. Ms. Diamant is offering
architectural services on her web site. A Notice and Order to Cease and Desist
was issued along with the requirement that Ms. Diamant sign an affidavit stating
she will change her web site and refrain from offering architectural or words to
that effect. If Ms. Diamant fails to return the affidavit, an Administrative
Complaint seeking fines will be filed.

Probable Cause was found that Kevin D. Atchley Design of Umatilla, Florida is
not licensed to practice architecture in the State of Florida and is offering
architectural services on a rate sheet. The rate sheet specifically offers
design services for commercial projects. A Notice and Order to Cease and Desist
was issued and an Administrative Complaint seeking fines was filed.
Scott R. Layne
Case No. 2006-033688
Probable cause was found that Scott Layne of Vero Beach, Florida is not
licensed to practice architecture in Florida. Mr. Layne works for a licensed
architect and he signed Application and Certificate for Payments forms as
“Architect”. A Notice and Order to Cease and Desist was issued along with the
requirement that Mr. Layne sign an affidavit stating he will refrain from using
the title architect or words to that effect. If Mr. Layne fails to return the
affidavit, an Administrative Complaint seeking fines will be filed.

Probable Cause was found that Wade Longmire of Pensacola, Florida is not
licensed to practice architecture in the State of Florida and is offering
architectural services in his letterhead. A Notice and Order to Cease and Desist
was issued along with the requirement that Mr. Longmire sign an affidavit
stating he will refrain from offering architectural services or words to that
effect and will change his letterhead. If Mr. Longmire fails to return the
affidavit, an Administrative Complaint seeking fines will be filed.

Probable Cause was found that Joseph Miraglia of Cherry Hill, New Jersey is
not licensed to practice interior design in the State of Florida and contracted
to provide interior design services on a condominium project. Further, Mr.
Miraglia holds himself out as an interior designer throughout the contract and
is offering such services through a business entity without a certificate of
authorization. A Notice and Order to Cease and Desist was issued and an
Administrative Complaint seeking fines was filed.

Probable Cause was found that Margaret H. O’Rourke of Winter Park, Florida is
not licensed to practice architecture in the State of Florida. Ms. O’Rourke’s
sign offers commercial design services and she prepared drawings for a
commercial project. Further, Ms. O’Rourke is offering such services through a
business entity without a certificate of authorization. A Notice and Order to
Cease and Desist was issued and an Administrative Complaint seeking fines was
filed.

Probable Cause was found that Roland Patterson of Jacksonville, Florida is
not licensed to practice architecture in the State of Florida and entered into a
contract to perform architectural services for a commercial project. Further,
Mr. Patterson’s business card offers architectural services and he prepared the
plans for the project. A Notice and Order to Cease and Desist was issued and an
Administrative Complaint seeking fines was filed.

Probable Cause was found that Michael Perry of Palm Beach, Florida is not
licensed to practice architecture in the State of Florida and contracted to
provide signed and sealed drawings by an architect for a residential remodeling
project. A Notice and Order to Cease and Desist was issued and an Administrative
Complaint seeking fines was filed.
Camilla Popham
Noble Interiors, Inc.
Case No. 2006-028864
Probable Cause was found that Camilla Popham of Miami, Florida is not
licensed to practice interior design in the State of Florida and contracted to
provide interior design services for a residence. The contract specifically
offers interior design services. Ms. Popham also prepared drawings for the
project that held themselves out as interior designers. A Notice and Order to
Cease and Desist was issued and an Administrative Complaint seeking fines was
filed.

Case No. 2005-061067
Probable cause was found that Properties Solution Service Corp. of Miami,
Florida is not licensed to practice architecture or interior design in Florida
and is offering architectural services in a brochure. A Notice and Order to
Cease and Desist was issued along with the requirement that Ms. Duran sign an
affidavit stating she will refrain from offering architectural services and will
change the brochure deleting any references to architecture or words to that
effect. If Ms. Duran fails to return the affidavit, an Administrative Complaint
seeking fines will be filed.
Antonio Sacerio

Case No. 2005-046160
Probable cause was found that Antonio Sacerio of Miami, Florida is not
licensed to practice architecture in Florida and is offering architectural
services on his business card. A Notice and Order to Cease and Desist was issued
along with the requirement that Mr. Sacerio sign an affidavit stating he will
refrain from offering architectural services and will change his business card
deleting any references to architecture or words to that effect. If Mr. Sacerio
fails to return the affidavit, an Administrative Complaint seeking fines will be
filed.
Sandra L. Sanchez
Able Remodeling & Design, Inc.
Case No. 2006-005622
Probable Cause was found that Sandra Sanchez of Mango, Florida is not
licensed to practice architecture in the State of Florida. Ms. Sanchez’ sign on
her truck offers architectural services. Ms. Sanchez is offering such services
through a business entity without a certificate of authorization. Further, Ms.
Sanchez submitted residential plans for permitting with the firm’s corporate
seal. A Notice and Order to Cease and Desist was issued and an Administrative
Complaint seeking fines was filed.
David Ser
Case Nos. 2005-027946 & 2005-013168
Probable Cause was found that David Ser of Miami, Florida was previously a
licensed architect in Florida; however, his license went delinquent on March 1,
2003 and then null and void on March 1, 2005. The complaint was based on two
cases in which Mr. Ser practiced architecture, held himself out a an architect
and used his null and void license number. A Notice and Order to Cease and
Desist was issued and an Administrative Complaint seeking fines was filed.

Gerhard Pelzer, Case No. 2006-005031
Probable Cause was found that the Subjects of Estrero, Florida are not
licensed to practice architecture or interior design in Florida and entered into
three contracts to provide architectural services for an office/retail space, a
32 unit condominium and a 14 unit condominium project. Further, Subjects’ title
block claims they are members of the American Institute of Architects. Further
Subjects are offering such services through a business entity without a
certificate of authorization. A Notice and Order to Cease and Desist was issued
an Administrative Complaint seeking fines was filed.
Doug Spencer
Doug Spencer Architectural Design, Inc.
Case No. 2005-022371
Probable Cause was found that Doug Spencer of Atlanta, Georgia is not
licensed to practice architecture in the State of Florida and his letterhead
offers architectural services. Further, Mr. Spencer is doing business as Dough
Spencer Architectural Design, Inc. without a certificate of authorization. At
the May 1, 2006 Probable Cause Panel meeting, probable cause was found and a
Notice and Order to Cease and Desist was issued. Mr. Spencer was hand served at
his last known address and as of today’s date failed to return the affidavit. An
Administrative Complaint seeking fines was filed.

Probable Cause was found that John Strickland of Alachua, Florida is not
licensed to practice architecture in Florida and held himself out as an
architect and contracted to provide architectural services for a church. A
Notice and Order to Cease and Desist was issued an Administrative Complaint
seeking fines was filed.
Anthony Thayer

Case No. 2006-007960
Probable Cause was found that Anthony Thayer of Daytona Beach, Florida is not
licensed to practice architecture in Florida and contracted to provide
residential plans that were signed and sealed by an architect. Mr. Thayer is
offering these services through a fictitious name without a certificate of
authorization. A Notice and Order to Cease and Desist was issued an
Administrative Complaint seeking fines was filed.

Case No. 2006-019227
Probable Cause was found that Leon Van Sikes of Jacksonville Beach, Florida
is not licensed to practice architecture in Florida and contracted and provided
architectural services for a residence and held himself out as an architect. A
Notice and Order to Cease and Desist was issued an Administrative Complaint
seeking fines was filed.

Probable cause was found that Wingate & Associates Realty, Inc. of Tampa,
Florida is not licensed to practice architecture in Florida and is offering
architectural services on its web site and on its signs. A Notice and Order to
Cease and Desist was issued along with the requirement that Ms. Wingate sign an
affidavit stating she will refrain from offering architectural services and will
change the firm’s web site and sign deleting any references to architecture or
words to that effect. If Ms. Wingate fails to return the affidavit, an
Administrative Complaint seeking fines will be filed.

Probable Cause was found that Debra Yates of Key West, Florida is not
licensed to practice interior design or architecture in Florida and is offering
interior design services in an advertisement. Ms. Yates’ web site is offering
architectural services and provides pictures of commercial projects. A Notice
and Order to Cease and Desist was issued an Administrative Complaint seeking
fines was filed.

Case No. 2006-028883
Probable Cause was found that Natasha Younts of Miami, Florida is not
licensed to practice interior design or architecture in Florida and is offering
interior design services in an advertisement that appeared in the Lincoln Road
Magazine. Ms. Younts’ website offers both interior design and architectural
services. A Notice and Order to Cease and Desist was issued an Administrative
Complaint seeking fines was filed.

Probable Cause was found that John Zonata of Valrico, Florida is not licensed
to practice architecture in Florida and contracted and provided architectural
services for a daycare center. A Notice and Order to Cease and Desist was issued
an Administrative Complaint seeking fines was filed.
I. Licensed Cases
E. Dean Bolaris
E. Dean Bolaris, P.A.
Case No. 2005-031944
Probable Cause was found that E. Dean Bolaris of Maitland, Florida, a
licensed architect in the State of Florida, violated chapter 481, Florida
Statutes. This case involved two separate complaints. The first one involved Mr.
Bolaris receiving a retainer on two projects. On one project, Mr. Bolaris did
not provide anything and on the other the drawings were unsatisfactory. In the
second case, it appeared that Mr. Bolaris overcharged the client and would not
provide a refund. Further, Mr. Bolaris is operating through a business entity
without a certificate of authorization. An Administrative Complaint seeking
discipline was filed.
Juan Carlos David
Case No. 2005-024834
Probable Cause was found that Juan Carlos David of Miami, Florida, a licensed
architect in the State of Florida, violated chapter 481, Florida Statutes. Mr.
David entered into a contract for the renovation of a residence which included a
new roof system. Mr. David was paid $15,000.00 but never performed under the
contract. Further, a default judgment has been entered against Mr. David in
Circuit Court for the contract amount. An Administrative Complaint seeking
discipline was filed.
Jose R. Figuerora
Case No. 2006-027030
Probable Cause was found that Jose Figuerora of Miami, Florida, a licensed
architect in the State of Florida, violated chapter 481, Florida Statutes. Mr.
Figuerora prepared residential drawings for a client but did not have a contract
with the client. The client’s contract was with an unlicensed individual that
was offering architectural services. An Administrative Complaint seeking
discipline was filed.
Mitzie M. Fisher
EDC & Associates, Inc.
Case No. 2006-039527
Probable Cause was found that Mitzie Fisher of St. Petersburg, Florida, a
licensed interior designer in the State of Florida, violated chapter 481,
Florida Statutes. Ms. Fisher is offering architectural services on her web site.
Further, Ms. Fisher is offering interior design services through a business
entity without a certificate of authorization. An Administrative Complaint
seeking discipline was filed.
Peter J. Goldhammer
Case No. 2005-0459
Probable Cause was found that Peter Goldhammer of St. Petersburg, Florida, a
licensed architect in the State of Florida, violated chapter 481, Florida
Statutes. Mr. Goldhammer signed and sealed plans of an electrical engineer that
were not his own. The plans also reference the 2001 Building Code rather than
the 2004 Building Code. The file was reviewed by the Board’s expert, Jerry
Hicks, who determined there were violations. An Administrative Complaint seeking
discipline was filed.
Neil Bradley Hall
Case No. 2005-046723
Probable Cause was found that Neil Bradley Hall of Slildell, Louisiana, a
licensed architect in the State of Florida, violated chapter 481, Florida
Statutes. The case is based on an audit of the continuing education credits
claimed by Mr. Hall when he renewed his license. Mr. Hall affirmed at renewal
that he had completed the required hours; however, he has not provided evidence
of having taken any continuing education hours during the audit period. An
Administrative Complaint seeking discipline was filed.
Ronald Kurowski
Case No. 2005-038674
Probable Cause was found that Ronald Kurowski of Clearwater, Florida, a
licensed architect in the State of Florida, violated chapter 481, Florida
Statutes. Mr. Kurowski signed and sealed plans that were not sufficiently
detailed. The plans were reviewed the Board’s expert, Jerry Hicks who determined
there was sufficient evidence to find that a violation occurred. Further, Mr.
Kurowski’s title block is not in compliance. An Administrative Complaint seeking
discipline was filed.
George J. Lopez
Case No. 2005-031129
Probable Cause was found that George J. Lopez of Miami, Florida, a licensed
architect in the State of Florida, violated chapter 481, Florida Statutes. Mr.
Lopez took over 10 months to complete drawings for a simple patio addition and
made misrepresentation to the client during this period regarding various delays
in the project. The plans that Mr. Lopez finally provided were incomplete. An
Administrative Complaint seeking discipline was filed.
Deborah Jean Neve
Case No. 2006-038289
Probable Cause was found that Deborah Neve of Key Biscayne, Florida, a
licensed architect in the State of Florida, violated chapter 481, Florida
Statutes. Ms. Neve was previously an officer of Design Spectrum International,
Inc. Ms. Neve is no longer an officer of the company; however, the firm is still
offering architectural and interior design services. Although Ms. Neve notified
the Secretary of the State that she was no longer an officer of the firm, she
failed to notify the Department of Business and Professional Regulation. This
enabled the business to continue to offer those services. An Administrative
Complaint seeking discipline was filed.
Harlan Edward Woodard
KDI Architecture, Inc.
Case No. 2005-059380
Probable Cause was found that Harlan Edward Woodard of Miami, Florida a
licensed architect in the State of Florida, violated chapter 481, Florida
Statutes. Mr. Woodard misrepresented to his client when his plans would be
completed. The file was reviewed by the Board’s expert, Jerry Hicks, who
determined that a violation. An Administrative Complaint seeking discipline was
filed.
Robert Zahradnik
Case No. 2006-037511
Probable Cause was found that Robert Zahradnik of Yalaha, Florida a licensed
architect in the State of Florida, violated chapter 481, Florida Statutes. Mr.
Zahradnik is signing and sealing drawings for an unlicensed draftsman that is
offering architectural services. Mr. Zahradnik is being paid directly by the
unlicensed draftsman. Both individuals are operating from offices over 18 miles
apart. An Administrative Complaint seeking discipline was filed.
